This is an appeal from an interlocutory judgment determining that Allan Axt was the employee of Highway Pavers, Inc., and
was not a "loaned employee" of W. J. Lazynski, Inc., and others. The facts are these: Highway Pavers, Inc., is a general contractor which contracted with the State Highway Commission to
construct a portion of the Milwaukee expressway. Axt was a crane operator employed by Highway Pavers. A portion of the work
was subcontracted to a joint enterprise consisting of W. J. Lazynski, Inc., and Koch & Bonness, Inc. (hereinafter referred
to as Koch). Paul L. Skornia, who was the injured plaintiff and respondent herein, was at all times undisputedly the employee
of Koch.
